1. Introduction
WebProgress.AI (“WebProgress,” “WPAI,” “we,” “us,” or “our“) is the primary brand of WebProgress.Net, Inc., an Illinois corporation operating since 2001, located at 1331 W Chase Ave, Chicago, IL 60626, United States. WebProgress.AI and WebProgress.Net refer to the same company.
We provide website design, web hosting, digital advertising, SEO, marketing, consulting, and AI-powered services. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit our websites, submit a form, purchase products or services, or use our AI features (collectively, the “Services“). By using the Services, you agree to this Privacy Policy. If you do not agree, please do not use the Services.
2. Scope
This policy covers WebProgress.AI’s own websites and Services (including the webprogress.ai and webprogress.net domains). Some WebProgress projects and product brands operate under their own names and may have their own privacy policies; where that is the case, the policy posted on that brand’s site governs that brand. Our AI features are also subject to our separate AI Terms, and certain marketing services to our Marketing Terms.
3. Information We Collect
a. Information you provide.
- Contact and identity details submitted through our forms (name, business name, email, phone, address).
- Account and order information when you purchase products or services, including billing details (payment card data is handled by our payment providers; we do not store full card numbers).
- Content, prompts, files, and materials you submit to us or into an AI feature, and communications you send us.
b. Information collected automatically.
- Device and usage data such as IP address, browser type, operating system, referring/exit pages, pages viewed, and timestamps.
- Cookies, pixels, and similar technologies (see Section 6).
c. Information from third parties.
- Data from advertising, analytics, hosting, and lead-generation partners, and publicly available business information, which we may combine with information we already hold.
4. How We Use Information
We use personal information to:
- Provide, operate, and improve our Services and websites;
- Respond to inquiries, provide quotes, and deliver web, hosting, advertising, SEO, marketing, consulting, and AI services;
- Fulfill orders, process payments, and manage accounts, subscriptions, and hosting;
- Generate AI outputs you request (see Section 5);
- Send administrative, transactional, and (where permitted) marketing communications;
- Operate and measure advertising and analytics;
- Detect, prevent, and address fraud, abuse, security, and technical issues;
- Comply with legal obligations and enforce our agreements.
5. AI-Powered Services and Your Data
Because AI is central to our Services, this section explains how we handle information in that context.
- What we process. When you use an AI-powered feature (such as AI chat or voice assistants, content generation, or CRM automation), we process the inputs you provide (“Inputs“) — including prompts, text, files, and contact data — to generate outputs (“Outputs“) for you.
- AI providers as sub-processors. Inputs may be transmitted to and processed by third-party AI platform and model providers acting as our service providers (“AI Providers“) solely to deliver the Service to you. These providers are contractually restricted in how they may use the data.
- Model training. We do not sell your personal information, and we do not authorize your business or client data to be used to train third-party public AI models beyond what is necessary to provide the Service. Where an AI Provider’s default settings would use Inputs for model training, we disable that option where it is available to us.
- Human review. We do not make decisions that produce legal or similarly significant effects about you based solely on automated processing without a lawful basis; where such processing occurs, you may request human review by contacting us.
- Accuracy. AI Outputs may be inaccurate or incomplete and should be reviewed before you rely on them. Further terms are in our AI Terms.
6. Cookies and Tracking Technologies
We use cookies and similar technologies to operate our sites, remember preferences, measure performance, and support advertising. Where required by law, we present a cookie banner allowing you to accept or manage non-essential cookies. You can also control cookies through your browser settings; disabling some cookies may affect functionality.
7. Advertising and Analytics
We use analytics and advertising services (which may include Google and Meta/Facebook) to understand site usage and to deliver and measure advertising, including remarketing. These providers may set their own cookies and collect information about your activity across sites. You can opt out of many interest-based ads through your ad-settings controls and industry opt-out pages.
8. Text Messaging (where applicable)
If you opt in to receive text (SMS/MMS) messages from us, message frequency varies and message and data rates may apply. You can opt out at any time by replying STOP, or reply HELP for help. We do not share mobile opt-in data with third parties for their own marketing.
9. How We Share Information
We do not sell personal information. We share it only as follows:
- Service providers / sub-processors — vendors performing services on our behalf, including hosting, payment processing, email/SMS delivery, analytics, advertising, and AI Providers, who may use it only to perform their functions.
- Legal and safety — when required by law or lawful request, or to protect the rights, property, or safety of WebProgress, our clients, or others.
- Business transfers — in connection with a merger, acquisition, reorganization, financing, or sale of assets, personal information may be transferred as part of that transaction, subject to this Policy.
10. Data Retention
We retain personal information for as long as needed to provide the Services, maintain accounts and hosting, comply with legal obligations, resolve disputes, and enforce agreements, after which we delete or de-identify it. AI Inputs and Outputs are retained only as long as needed to provide the Service and as described in our AI Terms.
11. Data Security
We use reasonable administrative, technical, and physical safeguards to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
12. Your Privacy Rights
Depending on where you live, you may have the right to access, correct, delete, or obtain a portable copy of your personal information; to opt out of marketing and of any “sale” or “sharing” (note: we do not sell personal information); to restrict or object to certain processing, including certain automated processing; and to withdraw consent. To exercise a right, contact us using Section 16. We will verify and respond as required by applicable law and will not discriminate against you for exercising these rights.
EU/EEA, UK, and other GDPR/DSGVO jurisdictions: our legal bases include performance of a contract, legitimate interests, consent, and legal obligation. You have rights regarding automated decision-making, and you may lodge a complaint with your local supervisory authority.
California residents (CCPA/CPRA): you have the rights above. We do not sell or share personal information as defined under California law.
13. International Data Transfers
We are based in the United States and may process information in the U.S. and other countries, including through our AI Providers. For transfers from the EU/EEA, UK, or Switzerland, we rely on appropriate safeguards such as Standard Contractual Clauses.
14. Children’s Privacy
Our Services are intended for businesses and adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us personal information, please contact us so we can delete it.
15. Third-Party Websites
Our sites may link to third-party sites we do not control. This Policy does not apply to those sites, and we encourage you to review their privacy policies.
